You Received an RFE or NOID from USCIS: What Does It Mean and What Should You Do Now?

Receiving a letter from USCIS and seeing words such as “Request for Evidence” or “Notice of Intent to Deny” can be overwhelming. Many people immediately assume that they have lost their case and that there is nothing else they can do. That reaction is understandable, but it is almost always mistaken.

An RFE (Request for Evidence) or a NOID (Notice of Intent to Deny) is not a denial. They are opportunities. The agency is telling you that your case is still active and that you still have an opportunity to influence the outcome.

An RFE means that the officer needs additional evidence to make a decision. A document may be missing, the information may not have been sufficient, or something may not have been clear. You respond, provide what is missing, and the case continues. As a general rule, USCIS gives up to 12 weeks (84 days) to respond, and that deadline cannot be extended.

A NOID is more serious. In this situation, the officer is already considering denying the case based on the information currently available, but gives you one final opportunity to challenge that conclusion before making a decision. The deadline is usually 30 days. This is not the time to send documents at random, but rather to address every point identified by the officer with evidence and a clear legal argument.

The most common mistake I see is treating these letters as if they were all the same. They are not. Each RFE and NOID identifies specific concerns, and your response must address those exact concerns. Sending a large number of documents without explaining how each one proves your eligibility rarely works.

The second mistake is ignoring the clock. The date shown on the letter is what matters. A late or incomplete response, or one that does not directly address what the officer requested, could cost you your case. If you do not respond, USCIS may deny the application for abandonment.

It is important to remember something that is sometimes overlooked: not every case is the same. What is being requested and what is at stake depends on your history, how you entered the country, previous applications, and other personal circumstances. That is why a response that worked for a friend or family member may not work for you.

If you received an RFE or NOID, keep in mind that your case is not lost, but it has entered a stage where every decision matters. Read the letter carefully, write down the deadline, and seek legal guidance before responding. A strong response submitted on time can often make the difference between an approval and a denial.
