Una jueza federal de California bloqueó la eliminación del Estatus de Protección Temporal (TPS) para más de 60,000 inmigrantes de Nicaragua, Honduras y Nepal, al determinar que la decisión del Gobierno fue ilegal y no cumplió con los procedimientos establecidos por la ley.

A federal judge in California blocked the termination of Temporary Protected Status (TPS) for more than 60,000 immigrants from Nicaragua, Honduras, and Nepal, ruling that the government's decision was illegal and did not comply with legally established procedures.

La magistrada Trina Thompson dictaminó este miércoles que la secretaria del Departamento de Seguridad Nacional (DHS), Kristi Noem, actuó de manera “predestinada” al ordenar la terminación del TPS y violó la Ley de Procedimiento Administrativo (APA) al no seguir el proceso regular requerido.

Judge Trina Thompson ruled Wednesday that Department of Homeland Security (DHS) Secretary Kristi Noem acted with premeditation in ordering the termination of TPS and violated the Administrative Procedure Act (APA) by failing to follow the required procedural steps.

Como resultado del fallo, la jueza restauró el TPS para los nacionales de los tres países y rechazó la solicitud del Gobierno para desestimar la demanda. Thompson subrayó que el DHS se apartó de su práctica habitual al reducir el periodo de transición tras la terminación del beneficio migratorio a solo 60 días.

As a result of the ruling, the judge reinstated TPS for nationals of the three countries and rejected the government's request to dismiss the lawsuit. Thompson emphasized that DHS deviated from its usual practice by reducing the transition period after the termination of the immigration benefit to only 60 days.

El dictamen también establece que la terminación del TPS para Nepal, programada para el 6 de junio de 2025, así como la de Honduras y Nicaragua, prevista un mes después, fueron ilegales bajo la normativa federal, dejando sin efecto la orden emitida por el DHS.

The ruling also establishes that the termination of TPS for Nepal, scheduled for June 6, 2025, as well as for Honduras and Nicaragua, planned for a month later, were illegal under federal law, nullifying the order issued by the Department of Homeland Security (DHS).

Los beneficiarios del TPS presentaron la demanda alegando que la cancelación del programa estuvo motivada por animosidad racial y que afectó injustamente a personas que han residido legalmente en Estados Unidos durante décadas.

TPS beneficiaries filed the lawsuit alleging that the program's cancellation was motivated by racial animosity and unfairly affected people who have resided legally in the United States for decades.

Organizaciones defensoras de los inmigrantes celebraron la decisión judicial, aunque advirtieron que la incertidumbre generada por la anulación previa ya causó daños significativos a muchas familias.

Immigrant advocacy organizations celebrated the court's decision, although they warned that the uncertainty generated by the previous cancellation had already caused significant harm to many families.

“La decisión de hoy restaura las protecciones del TPS para miles de migrantes, y los empleadores están legalmente obligados a respetar sus permisos de trabajo vigentes”, señaló Ahilan Arulanantham, codirector del Centro de Derecho y Política Migratorios de la Universidad de California en Los Ángeles (UCLA).

“Today’s decision restores TPS protections for thousands of migrants, and employers are legally obligated to respect their current work permits,” said Ahilan Arulanantham, co-director of the Center for Immigration Law and Policy at the University of California, Los Angeles (UCLA).

El TPS es un beneficio migratorio otorgado por el DHS a ciudadanos de países que enfrentan condiciones extraordinarias, como desastres naturales, conflictos armados u otras crisis, que impiden un retorno seguro a su lugar de origen.

TPS is an immigration benefit granted by the DHS to citizens of countries facing extraordinary conditions, such as natural disasters, armed conflicts, or other crises, that prevent a safe return to their place of origin.
