THE DISCRETION OF IMMIGRATION OFFICERS: A GROWING LEGAL PROBLEM

One of the most serious legal problems we face today in the immigration system is not a new law, but a less visible change: more and more decisions with significant consequences can be made in the early stages of a case by administrative officers, before a person has the opportunity to present their case before a judge.

It is not always a matter of officers having greater freedom. In some cases, new policies actually require them to act more strictly. But the result is similar: a decision made at a desk, while reviewing a file, or even at an airport can determine whether a person ultimately faces deportation proceedings.

Permanent Residents May Also Face Difficult Decisions at the Border

Green card holders generally do not have to apply for admission to the United States again when returning from temporary travel abroad. However, the law establishes several exceptions.

Lau.

One of these exceptions was the subject of an important Supreme Court decision on June 23, 2026: Blanche v. Lau.

The Court determined that a border officer does not need clear and convincing evidence that a permanent resident committed a crime involving moral turpitude before treating that individual as a person seeking admission to the country. Nor is an existing conviction required to make that initial determination at the border.

This does not mean that a mere accusation automatically makes a permanent resident deportable. The government must still subsequently establish the necessary elements to support the applicable ground of inadmissibility or deportation.

However, the decision has an important consequence: a permanent resident who travels outside the United States and has certain criminal records or pending criminal accusations may face a much more complicated immigration situation upon returning, even before the criminal case has concluded.

USCIS Is Also Sending More Cases to Immigration Court

In February 2025, USCIS modified its policy regarding Notices to Appear, known as NTAs, which are the documents used to initiate removal proceedings before Immigration Court.

Under that policy, when USCIS issues an unfavorable decision on an immigration benefit application and determines that the person is not lawfully present in the United States, it generally must issue an NTA. The ability to refrain from doing so through prosecutorial discretion was limited to exceptional circumstances.

In August 2025, USCIS also updated its policies regarding family-based petitions and clarified something many families do not realize: having a pending or even approved family petition does not, by itself, grant immigration status or prevent the government from initiating removal proceedings when the person is deportable.

This considerably increases the importance of evaluating not only whether a person qualifies to submit an immigration application, but also what could happen if USCIS ultimately denies it.

Asylum Officers Have Also Received New Authority

Another important change occurred in the asylum process.

Since July 28, 2026, a new regulation called Affirmative Asylum Referrals Without Interview has allowed certain affirmative asylum cases to be referred directly to Immigration Court without USCIS first interviewing the applicant.

For years, USCIS maintained the practice of offering an interview to individuals who filed asylum applications under its jurisdiction before making a decision on the case.

Now, an officer can review the file and refer certain cases directly to an immigration judge without a prior interview. This can occur, among other circumstances, when the officer determines that a legal bar to applying for or receiving asylum exists, that the case does not meet the legal requirements, or that the person does not warrant a favorable exercise of discretion.

The potential scale of this change is considerable. The Department of Homeland Security itself estimated that approximately 132,000 future applications per year could be affected by some of these categories. It also calculated that at least 444,000 already pending cases could potentially be affected solely by issues related to the one-year deadline for applying for asylum.

This does not mean that these individuals are automatically deported. Referral to Immigration Court allows the applicant to continue defending their asylum claim before a judge. But it changes something fundamental: USCIS can send a person into removal proceedings without first interviewing them.

The Real Problem: Early Decisions With Enormous Consequences

Estos cambios tienen algo en común.

These changes have something in common.

A decision made by an officer can radically change the course of a case before a full hearing takes place before a judge.

For a permanent resident returning from a trip, it may be the decision to treat that person as an applicant for admission once again.

For a person without legal status who applies for a benefit through USCIS, an unfavorable decision may be accompanied by an NTA.

For an asylum applicant, reviewing the written file may be enough to send the case directly to Immigration Court without a prior interview.

The problem is not simply that immigration policies are becoming stricter. The legal issue is how much can depend on administrative decisions made in the early stages of the process and how much opportunity exists to correct them before they produce significant consequences.

What Can an Attorney Do in Response?

In this environment, an attorney's work becomes more demanding on several fronts:

Document every case thoroughly. If a decision can be made solely by reviewing the file, we can no longer assume there will be a subsequent interview to explain an inconsistency or complete the story.

Assess risks before filing. It is no longer enough to ask whether a person can apply for a particular benefit. We must also analyze what could happen if the application is denied.

- Mantenerse actualizado constantemente.

Stay constantly informed. Immigration policies are changing rapidly, and court decisions, regulations, and internal memoranda can significantly alter how a case is processed.

Challenge decisions when appropriate. The existence of administrative discretion does not mean government decisions are immune from review. Attorneys must identify when an agency exceeds its authority or incorrectly applies the law.

The cost of these changes is not borne by attorneys alone. Proceedings can become more complex, more expensive, and more emotionally exhausting for immigrant families.

In a system where an early administrative decision can determine whether someone continues their application normally or ends up before an immigration judge, proper preparation from the very beginning has never been more important.
