Ante la creciente preocupación de comunidades inmigrantes en distintas ciudades de Estados Unidos por la actividad del Servicio de Inmigración y Control de Aduanas (ICE), la alcaldesa de St. Louis, Cara Spencer, envió una carta dirigida a organizaciones comunitarias y líderes locales para aclarar la postura de la ciudad y responder a inquietudes sobre la presencia y las acciones de las autoridades federales de inmigración. En el mensaje, la alcaldesa reafirma el compromiso de la administración municipal de apoyar y proteger a las comunidades nacidas en el extranjero, así como de mantener una comunicación abierta con quienes trabajan directamente con estas poblaciones. Amid growing concerns among immigrant communities across the United States regarding the activities of Immigration and Customs Enforcement (ICE), St. Louis Mayor Cara Spencer sent a letter to community organizations and local leaders to clarify the city’s position and address questions about the presence and actions of federal immigration authorities. In the message, the mayor reaffirms the city administration’s commitment to supporting and protecting foreign-born communities while maintaining open communication with those who work directly with them. Below is the full text of the letter shared by the mayor’s office.

Dear community partners,

Como ciudad, nos encontramos en tiempos inciertos y sin precedentes. Nos sentimos honrados de ser hogar de miles de inmigrantes en toda la ciudad de St. Louis y, como se ha visto en distintas partes del país, sabemos que el temor hacia el Servicio de Inmigración y Control de Aduanas (ICE) no se limita únicamente a las personas sin documentos. As a city, we find ourselves in uncertain and unprecedented times. We are honored to be home to thousands of immigrants across the City of St. Louis and, as witnessed around the nation, we know that fear of Immigration and Customs Enforcement (ICE) is not limited to people without documentation. With the valid concerns of our foreign-born communities in mind, we wanted to reach out to share the information we currently have available.

We will never stop doing what we can to support and protect our immigrant communities, and we will never stop listening to your fears, ideas, and needs. We believe that diversity makes us stronger, and we value you and your service to our city’s foreign-born communities.

In addition to offering a statement of support, we also want to address some of the questions we have received over the past few months.

1. La Ciudad no está trabajando con ICE.

1. The City is not working with ICE.

Legally, ICE can operate in our city as a federal agency, but our city departments and agencies are not collaborating with them. This means we are not meeting with ICE, we are not providing names of individuals suspected of having unverifiable immigration status, and we are not sharing information about communities or residents.

La única excepción a esta regla es que el Departamento de Policía Metropolitana de St. Louis puede contactar a ICE si una persona es arrestada y su estatus migratorio no puede confirmarse. Sin embargo, la policía no contactará a ICE en casos de delitos no violentos, como infracciones de tránsito.

The only exception is that the St. Louis Metropolitan Police Department may contact ICE if someone is arrested and their immigration status cannot be confirmed. However, the police will not contact ICE for non-violent offenses such as traffic violations.

2. There are currently no plans to build immigration detention centers in the city.

The City has received information from trusted federal partners that no immigration detention centers are currently planned to be built or established in St. Louis.

Recientemente se presentó un proyecto de ley ante la Junta de Concejales de St. Louis con el objetivo de tratar de prevenir que dichos centros se construyan o establezcan dentro de la ciudad. A bill was recently filed at the St. Louis Board of Aldermen in an effort to prevent such facilities from being built or established within the city. However, under federal law, the federal government could establish a detention center without needing the city’s permission. The City continues to actively monitor this issue for any potential changes.

3. What to do if you see ICE agents.

If you suspect the presence of ICE agents, the first thing you can do is take a photo or video of the agent or agents, or of any vehicles involved. There may be different federal agencies operating in the city, so it is important to obtain clear evidence identifying the agency through uniforms or vehicle markings.

4. Jurisdicción de ICE en la ciudad de St. Louis.

En cuanto a la jurisdicción de ICE, la agencia puede legalmente arrestar a una persona cuando esta se encuentra fuera de su vivienda. Sin embargo, las autoridades no pueden entrar a su casa o a un espacio privado sin una orden firmada por un juez.

4. ICE jurisdiction within the City of St. Louis.

Regarding ICE’s jurisdiction, the agency can legally arrest individuals when they are outside their homes. However, law enforcement cannot enter your home or a private space without a warrant signed by a judge.

Additionally, in 2022 the mayor signed an executive order banning “no-knock” search warrants in the city, requiring officers to announce their presence before entering a property. This ban remains in effect.

In public buildings such as City Hall and the St. Louis Municipal Court, public areas like foyers, hallways, and reception areas are legally accessible to ICE. However, private administrative offices beyond those areas typically require a warrant or consent for entry.

These are City Marshals, who provide security and protection for city government facilities and workers in the Municipal Courts, City Hall, and Police Headquarters. They are not ICE and do not work with ICE.
