EB-2 NIW Visas: A Real Opportunity or a Temporary Window?

El reciente movimiento del Visa Bulletin ha generado un impacto inesperado en la comunidad migratoria: la categoría EB-2 aparece “current” para la mayoría de los países. Para miles de profesionales que llevan años esperando avanzar en su proceso de residencia, esta noticia puede representar un antes y un después. Pero también plantea una pregunta clave: ¿es una oportunidad sólida o una ventana que podría cerrarse rápidamente?
The recent movement of the Visa Bulletin has generated an unexpected impact in the immigration community: the EB-2 category appears “current” for most countries. For thousands of professionals who have waited years to move forward in their residency process, this news could represent a turning point. However, it also raises a key question: is this a solid opportunity or a window that could close quickly?
El Visa Bulletin es el documento mensual que publica el Departamento de Estado de Estados Unidos y que determina cuándo una persona puede avanzar hacia la residencia permanente, según su categoría y país de origen. Cuando una categoría está “current”, significa que no hay lista de espera activa y que quienes sean elegibles pueden presentar su ajuste de estatus de inmediato.
The Visa Bulletin is the monthly document published by the U.S. Department of State that determines when a person can move forward toward permanent residency, depending on their category and country of origin. When a category is “current,” it means there is no active waiting list and those who are eligible can file their adjustment of status immediately.
Este movimiento no se veía desde hace años. La razón principal responde a un fenómeno técnico: el “spillover” de visas familiares no utilizadas hacia la categoría de empleo. En términos simples, el sistema funciona como dos baldes: si el de familia no se llena, el excedente pasa al de empleo. Además, la menor demanda en ciertos procesos consulares permitió liberar números disponibles.
This movement had not been seen in years. The main reason is a technical phenomenon known as the “spillover” of unused family visas into the employment category. In simple terms, the system works like two buckets: if the family bucket is not filled, the excess moves to the employment one. Additionally, lower demand in certain consular processes allowed more visa numbers to become available.
La EB-2 NIW (National Interest Waiver) forma parte de la categoría EB-2. Por lo tanto, si está “current”, quienes ya tienen su I-140 aprobada —o incluso pendiente en ciertos escenarios— podrían estar en posición de presentar ajuste de estatus inmediatamente. Sin embargo, tener la I-140 aprobada no es lo mismo que tener la residencia garantizada. El ajuste implica una nueva etapa, con análisis adicionales de elegibilidad y posibles riesgos individuales.
The EB-2 NIW (National Interest Waiver) is part of the EB-2 category. Therefore, if it is “current,” those who already have an approved I-140 —or even one pending in certain scenarios— may be in a position to file for adjustment of status immediately. However, having an approved I-140 is not the same as having residency guaranteed. The adjustment process involves a new stage, with additional eligibility reviews and possible individual risks.
¿Quiénes deberían prestar atención ahora? Profesionales con NIW aprobado, personas con I-140 pendiente, titulares de H-1B y quienes esperaban que su priority date avanzara. Pero también quienes, en medio de un clima de mayor fiscalización migratoria y aumento en detenciones, necesitan fortalecer su estatus antes de quedar expuestos a la incertidumbre.
Who should pay attention now? Professionals with an approved NIW, individuals with a pending I-140, H-1B holders, and those waiting for their priority date to move forward. But also those who, in the midst of increased immigration enforcement and rising detentions, need to strengthen their status before facing greater uncertainty.
Históricamente, movimientos similares han sido seguidos por “retrogression”: cuando la demanda aumenta, las fechas vuelven a retroceder. Por eso, el mayor error sería asumir que “current” significa aprobación automática o que la ventana permanecerá abierta indefinidamente.

El mensaje es claro: “current” no es garantía, es oportunidad. Y las oportunidades migratorias no se improvisan; se preparan.
The message is clear: “current” is not a guarantee, it is an opportunity. And immigration opportunities are not improvised; they must be prepared.
