El intrusismo profesional siempre ha sido un problema que termina afectando a los más necesitados. En el caso de los trámites migratorios en Estados Unidos, hoy aflora una gran cantidad de compañías de notarías, personas que se hacen llamar “paralegales”, que ofrecen servicios de inmigración y afectan la imagen de los que realmente hacen este trabajo.
Estas empresas reciben y atienden a personas que cruzan la frontera, a pesar de que, básicamente, esos procedimientos no se realizan ante el Servicio de Inmigración, sino ante las cortes, donde no pueden representar absolutamente a nadie.
¿El resultado? Hacen envíos de documentación deficiente a las cortes. En muchas ocasiones, ni siquiera saben adónde o cómo deben ejecutar el procedimiento, porque no tienen acceso, ni credenciales para ello. Y, además, envían solicitudes al Servicio de Inmigración, sin tener jurisdicción para atender este tipo de peticiones cuando no lo amerita.
El peligro es que las personas necesitadas puedan, muy probablemente, quedarse sin la presentación de sus casos de asilo, dentro del lapso de un año, que es lo que se exige por ley, salvo excepciones que hay que delimitar muy bien.
Y, de alguna manera, las empresas e individuos involucrados, aunque no dicen expresamente que son abogados licenciados en Estados Unidos, porque no lo son, sus nombres y la manera en que se identifican o promueven dan a entender al inmigrante que realmente están tratando con abogados.
Entonces, obviamente, esto se ha convertido en un tema muy peligroso, porque, ya de por sí, la probabilidad de ganar este tipo de casos es bastante baja.
Y si sumamos la falta de representación, de técnica jurídica adecuada y de fallos en la presentación de la documentación en el organismo o agencia correspondiente, pues obviamente el resultado será catastrófico para ese solicitante y su grupo familiar.

Professional intrusion has always been a problem that ends up affecting those most in need. In the case of immigration procedures in the United States, today there is a large number of notary companies, people who call themselves “paralegals”, who offer immigration services and affect the image of those who really do this work.
These companies receive and serve people who cross the border, despite the fact that, basically, these procedures are not carried out before the Immigration Service, but before the courts, where they cannot represent anyone at all.
The result? They send poor documentation to the courts. On many occasions, they do not even know where or how to execute the procedure, because they do not have access or credentials to do so. And, in addition, they send requests to the Immigration Service, without having jurisdiction to attend to this type of request when it is not warranted.
The danger is that people in need may very likely be left without presenting their asylum cases within a year, which is what is required by law, with exceptions that must be well defined.
And, somehow, the companies and individuals involved, although they do not expressly say that they are lawyers licensed in the United States, because they are not, their names and the way in which they identify themselves or promote themselves make the immigrant understand that they are really dealing with lawyers.
So, obviously, this has become a very dangerous issue, because, by itself, the probability of winning these types of cases is quite low.
And if we add the lack of representation, of adequate legal technique and failures in the presentation of the documentation in the corresponding body or agency, then obviously the result will be catastrophic for that applicant and his family group.
