Previous law allowed a person to file for divorce during pregnancy, but a provision dating back to 1973 could be interpreted in a way that prevented the process from being finalized until after the baby was born. For Williams, the legislation also carries personal significance. The lawmaker has said that in 2005 a judge declined to finalize her divorce while she was pregnant, leaving her, according to her account, in an abusive and dangerous situation.

“The barrier kept me in a very dangerous situation,” Williams said while discussing the experience that helped motivate the legislative change.

The reform can also apply when someone wants to divorce a spouse who is expecting a child conceived with another person.

Williams relató el caso de uno de sus electores, un militar que estuvo desplegado durante nueve meses y, al regresar, descubrió que su esposa tenía aproximadamente cinco meses de embarazo.

Williams described the case of one of her constituents, a servicemember who was deployed for nine months and returned to discover that his wife was approximately five months pregnant.

According to Williams, under the previous legal situation he also could not immediately finalize the divorce even though the pregnancy did not result from the marriage. The case also highlighted questions surrounding the legal presumption of paternity and the procedures required to establish it.

ATTORNEY SAYS QUESTIONS STILL NEED TO BE ADDRESSED

While family law attorney Kirk Stange sees no problem with judges being allowed to finalize a divorce during pregnancy, he said the new legislation could have more clearly defined how courts should handle issues involving custody, paternity and child support.
