Missouri Drops Lawsuit Seeking to Exclude Noncitizens from Census Count

Missouri Attorney General Catherine Hanaway withdrew the federal lawsuit the state had filed seeking changes to how residents are counted for purposes of the U.S. Census. The lawsuit, filed in January in federal court in St. Louis, requested that undocumented immigrants and temporary visa holders be excluded from the basis used to determine the apportionment of seats in the House of Representatives. The original filing confirms that Missouri was seeking a court order related to the 2030 Census and also challenged the apportionment based on the 2020 Census.

According to material published by the St. Louis Post-Dispatch, Hanaway's office decided to
withdraw the case after the Census Bureau proposed on Sept. 9 a new rule that contemplates counting only U.S. citizens and permanent residents in the decennial Census. The attorney general's office noted that the proposal coincides with its interpretation of the law and that it will now focus its efforts on supporting the Trump administration in advocating for an eventual final rule. The proposal would still have to complete the corresponding federal process before becoming a final rule.
El retiro de la demanda representa un cambio respecto a la posición que la oficina de Hanaway había presentado anteriormente ante el tribunal. The withdrawal of the lawsuit represents a change from the position Hanaway's office had previously filed with the court. In July, the state's lawyers had questioned whether a future Commerce Department rule would be sufficient to resolve Missouri's claims and had said it was unclear whether that proposal would ever become a final rule. The original lawsuit argued that Missouri could be affected in congressional representation by including noncitizen residents in the count.
