Student Sues St. Louis Public Schools After Suspension Over Snapchat Message

A senior at Metro Academic and Classical High School*has filed a federal lawsuit against St. Louis Public Schools (SLPS), alleging the district violated his First Amendment rights by suspending him over a Snapchat message sent to a female classmate outside of school hours. The lawsuit was filed by Jessica Shatto on behalf of her minor son, identified only as C.S., and names SLPS and network Superintendent Sheila Sherman as defendants. According to the lawsuit, C.S. sent the message “Trade?” from his home to a classmate on September 9, a term that on Snapchat can be understood as an invitation to exchange photos, including those of a sexual nature.

Según el documento, C.S. se arrepintió inmediatamente, bloqueó a la estudiante, cerró su cuenta y eliminó la aplicación, y no se intercambiaron fotografías ni otros mensajes. The lawsuit acknowledges that the message was “inappropriate” but argues that it did not constitute flagrant or repeated harassment. According to the filing, C.S. immediately regretted sending it, blocked the student, closed his account and deleted the app, and no photographs or additional messages were exchanged. The next day, he received an out-of-school suspension for a minimum of 10 school days for “harassment, bullying, violence, sexual or other serious misconduct.” A letter from a Metro assistant principal described the conduct as

repeated or flagrant serious harassment, while the lawsuit disputes that characterization.

Following a disciplinary conference on September 15, C.S. was reassigned to the district’s Virtual Learning Academy for online classes through the fall semester, and according to the lawsuit, Sherman denied an appeal because the student admitted sending the message. The family argues that the reassignment is harming his education because the virtual program does not provide the same advanced courses he was taking at Metro, including Advanced Placement (AP) and International Baccalaureate (IB) classes. The lawsuit contends that without immediate court intervention, the student could fall behind academically.

La demanda pide a un juez federal que ordene a SLPS levantar la suspensión y permitir que C.S. regrese a Metro Academic and Classical High School, además de otorgar compensación por daños y gastos legales. El caso plantea una disputa sobre los límites de la autoridad de las escuelas públicas para disciplinar a estudiantes por expresiones realizadas fuera del plantel y fuera del horario escolar. The lawsuit asks a federal judge to order SLPS to lift the suspension and allow C.S. to return to Metro Academic and Classical High School, as well as award damages and legal fees. The case raises a dispute over the limits of a public school district’s authority to discipline students for speech made off campus and outside school hours. St. Louis Public Schools said it would not comment on the specifics of the case because it involves pending litigation and a student.
