En un accidente causado por un conductor distraído, inmediatamente se piensa en alguien enviando un mensaje de texto mientras está al volante. Pero la distracción va mucho más allá de los mensajes: comer, maquillarse, cambiar la estación de radio, programar el GPS, mirar una aplicación de navegación, hablar con pasajeros o simplemente interactuar con el teléfono pueden quitarle al conductor la atención que necesita para reaccionar a tiempo.
When an accident is caused by a distracted driver, people immediately think of someone texting behind the wheel. But distraction goes far beyond text messages: eating, applying makeup, changing the radio station, programming the GPS, looking at a navigation app, talking with passengers, or simply interacting with a phone can take away the attention a driver needs to react in time.

For accident victims, this raises an important question: how can we know what the other driver was actually doing in the seconds before the impact?
“Hoy, un teléfono celular, las cámaras de seguridad y otros dispositivos pueden dejar un rastro digital que podría ayudar a reconstruir lo ocurrido. En la investigación de un accidente, puede ser importante determinar si el conductor estaba utilizando su teléfono y, sobre todo, qué estaba haciendo”, explica Jany Martínez-Ward, abogada de accidentes y socia fundadora de Ward Law.
“Today, a cellphone, security cameras, and other devices can leave a digital trail that could help reconstruct what happened. In an accident investigation, it may be important to determine whether the driver was using their phone and, above all, what they were doing,” explains Jany Martínez-Ward, accident attorney and founding partner of Ward Law.
La experta asegura que una llamada, mensajes u otras interacciones con el dispositivo pueden ser evidencia potencialmente relevante. Sin embargo, no toda información está disponible automáticamente. Dependiendo del caso, la jurisdicción y el tipo de registro, obtener ciertos datos puede requerir un proceso legal.
The expert says that a call, messages, or other interactions with the device may be potentially relevant evidence. However, not all information is automatically available. Depending on the case, jurisdiction, and type of record, obtaining certain data may require a legal process.
“Una investigación completa no debería limitarse a preguntar si el chofer estaba enviando mensajes. La pregunta debería ser qué estaba haciendo en los momentos previos al accidente. Hay muchas conductas que pueden ser relevantes si apartaron su atención y contribuyeron al accidente: cámaras en calles, negocios o propiedades cercanas pueden ser muy importantes y sus grabaciones ayudar a demostrar lo que realmente ocurrió, pero muchas se borran o se sobrescriben con el tiempo”, añade Martínez-Ward.
“A complete investigation should not be limited to asking whether the driver was texting. The question should be what the driver was doing in the moments before the accident. Many behaviors may be relevant if they diverted the driver’s attention and contributed to the accident: cameras on streets, at businesses, or on nearby properties can be very important, and their recordings can help demonstrate what actually happened, but many are deleted or overwritten over time,” Martínez-Ward adds.
